Terms of Service

These Terms of Service ("Terms") govern your access to and use of fairwaycircuit.com, app.fairwaycircuit.com, and any subdomain operated by Fairway Circuit LLC ("Fairway Circuit," "we," "us," or "our") (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. Users between 13 and 17 must have parental or guardian consent.

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your account credentials.

2. Your Account

You are responsible for:

  • All activity that occurs under your account
  • Maintaining the confidentiality of your password
  • Notifying us promptly of any unauthorized access at hello@fairwaycircuit.com

You may not:

  • Share your account with others
  • Create multiple accounts to circumvent league rules or pricing
  • Impersonate another person or misrepresent your identity

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Post false, misleading, or inflated scores
  • Manipulate your handicap to gain a competitive advantage (sandbagging)
  • Harass, threaten, or abuse other users
  • Post content that is defamatory, obscene, hateful, or illegal
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools (bots, scrapers) to access or interact with the Service without permission
  • Interfere with the operation of the Service or other users' enjoyment of it

We reserve the right to suspend or terminate accounts that violate these rules.

4. League Membership

If you join a league through the Service:

  • League organizers and administrators set their own rules, including membership requirements, attendance expectations, and competitive formats
  • Each league may have its own additional terms (membership policies, fees, codes of conduct)
  • Repeated violations of league rules (no-shows, late cancellations, false scores, etc.) may result in removal from the league
  • Membership in one league does not grant rights to other leagues

Fairway Circuit is the platform; individual leagues are operated by their organizers and members.

5. Subscription and Payment

Free Tier

The Service offers a free tier with limited functionality. No payment information is required.

Paid Subscriptions

Paid plans are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fees.

Refunds

  • Monthly subscriptions: Non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Annual subscriptions: Non-refundable after 14 days from initial purchase. Within the first 14 days, contact hello@fairwaycircuit.com for a prorated refund.

Price Changes

We may change subscription prices with at least 30 days' notice. If you do not agree to the new pricing, you may cancel before the change takes effect.

Payment Failures

If a payment fails, we will attempt to charge your payment method again. If we cannot collect payment within 14 days, we may suspend or downgrade your account.

6. Content

Your Content

You retain ownership of content you post to the Service (scores, messages, photos, etc.). By posting content, you grant Fairway Circuit a non-exclusive, royalty-free license to use, display, and distribute your content as necessary to operate the Service.

Public Display

If your league has a public results page and you have opted in to public listing, your name, handicap, scores, and league activity may be visible to non-members. You can opt out at any time per our Privacy Policy.

Our Content

The Service, including its design, features, and underlying software, is owned by Fairway Circuit and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

AI-Generated Content

The Service uses AI (Anthropic Claude) to generate league newsletters and summaries. AI-generated content:

  • Is based on real league data (scores, standings, events)
  • May occasionally contain errors or inaccuracies
  • Is reviewed by league organizers before being sent to members
  • Should not be relied upon as the sole source of truth for league results

7. Service Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted availability. We may:

  • Take the Service offline for maintenance, updates, or bug fixes
  • Modify or discontinue features with reasonable notice
  • Suspend access for users who violate these Terms

We are not liable for damages caused by Service unavailability.

8. Third-Party Services

The Service integrates with third-party services including:

  • Stripe (payments)
  • Supabase (database)
  • Resend (email)
  • GHIN/USGA (handicap lookup)
  • GolfNow (tee time information)
  • Anthropic (AI features)

Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or other harmful components
  • Information obtained through the Service will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRWAY CIRCUIT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR
  • $100 USD

This limitation applies even if Fairway Circuit has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Fairway Circuit LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights (including intellectual property or privacy rights)
  • Content you post to the Service

12. Termination

By You

You may terminate your account at any time by emailing hello@fairwaycircuit.com or using the cancellation feature in the Service.

By Us

We may suspend or terminate your account at any time, with or without notice, if:

  • You violate these Terms
  • You engage in fraudulent or abusive behavior
  • We are required to do so by law
  • We discontinue the Service

Upon termination:

  • Your access to the Service will end
  • Paid subscription fees are non-refundable except as stated in Section 5
  • Sections of these Terms that by their nature should survive (intellectual property, indemnification, limitation of liability, dispute resolution) will survive termination

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in Kane County, Illinois, except that:

  • Either party may bring an individual claim in small claims court
  • Either party may seek injunctive relief in court for intellectual property infringement

You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

  • Update the "Last Updated" date at the top
  • Post the new Terms at this URL
  • For material changes, notify users by email or in-app notification at least 14 days before the change takes effect

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fairway Circuit regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
